Frequently asked questions

Is TAN required for Section 194-IA?
No. Buyers are not required to obtain a Tax Deduction Account Number (TAN) for filing Form 26QB. This is one of the few TDS provisions where TAN is exempt; you only need your PAN.
What is Form 26QB?
Form 26QB is the challan-cum-statement used to deposit TDS deducted under Section 194-IA. It captures buyer details, seller details, property address, sale consideration, and the TDS amount paid. It must be filed within 30 days from the end of the month in which TDS is deducted.
What is Form 16B?
Form 16B is the TDS certificate issued by the buyer to the seller after successfully filing Form 26QB and payment of TDS. The seller uses this to claim credit for TDS deducted in their income tax return.
When exactly does the TDS obligation arise?
TDS must be deducted at the time of payment or credit to the seller, whichever is earlier. If you pay the sale amount in instalments, TDS must be deducted on each instalment. The filing deadline is 30 days from the end of the month of deduction.
What if there are multiple buyers or sellers?
A separate Form 26QB must generally be filed for each buyer-seller combination. For example, if two buyers are purchasing from one seller, two Form 26QB filings are required. Our Comprehensive plan handles this without additional charges.
What happens if TDS is not deducted or filed on time?
Interest at 1% per month is charged if TDS is not deducted, and 1.5% per month if deducted but not deposited. A late filing fee of ₹200 per day under Section 234E applies for each day of delay. Penalties under Section 271H can also be levied. These can add up quickly on high-value property transactions.
Does this apply to NRI sellers?
Section 194-IA applies when the seller is a resident Indian. For NRI sellers, a different provision (Section 195) applies with a much higher TDS rate. Our Comprehensive plan includes NRI transaction guidance.
Can errors in Form 26QB be corrected?
Yes. Corrections to PAN, amount, or property details can be filed as a correction statement. However, corrections have a specific process and timeline. Our Comprehensive plan covers one round of corrections after initial filing.
